Terms and Conditions

These Terms and Conditions ("Terms") govern your use of yourbrainonpickleball.com (the "Site") and the private pickleball coaching services (the "Services") offered by Joe C. Montgomery, doing business as "Your Brain on Pickleball" ("we," "us," or "our"). By accessing the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.

1. About Us

Your Brain on Pickleball is a sole proprietorship owned and operated by Joe C. Montgomery, based in the United States, providing private, in-person pickleball coaching and instruction.

2. Use of the Site

The Site is provided for informational purposes and to allow visitors to learn about our coaching services and contact us to schedule sessions. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law;
  • Attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems;
  • Introduce viruses, malware, or other harmful code to the Site;
  • Scrape, copy, or reproduce content from the Site without our prior written consent.

3. No Online Payments

The Site does not process, collect, or store payment information, and no payments are made through the Site. Any fees, deposits, or payments for coaching Services are discussed and handled directly between you and Joe C. Montgomery, outside of the Site, using payment methods agreed upon separately (for example, cash, check, or a third-party payment app). These Terms do not govern the specific payment method used; any such arrangement will be confirmed directly with you.

4. Coaching Services — Assumption of Risk

Pickleball and related physical activity involve inherent risks of injury, including but not limited to sprains, strains, fractures, cardiovascular events, collisions, falls, and other injuries, which can result from participation regardless of the level of care taken to avoid injury.

By engaging in coaching sessions or other Services with Joe C. Montgomery, you acknowledge and agree that:

  • You are voluntarily participating in physical activity and assume all risks associated with that participation, known and unknown;
  • You represent that you are physically fit and have no medical condition that would prevent your safe participation, or that you have consulted a physician and been cleared to participate;
  • You are responsible for using your own judgment about your physical limits during any session;
  • To the fullest extent permitted by law, you release and hold harmless Joe C. Montgomery and Your Brain on Pickleball from any and all claims, liabilities, injuries, damages, or losses arising out of or related to your participation in coaching sessions, except to the extent caused by gross negligence or willful misconduct.

Clients may be asked to sign a separate written waiver and assumption-of-risk agreement prior to participating in in-person coaching sessions. Nothing on the Site constitutes medical advice, and you should consult a physician before beginning any new physical activity program.

5. Scheduling, Cancellations, and Fees

Scheduling, rescheduling, cancellation policies, and fees for coaching sessions will be communicated directly between you and Joe C. Montgomery at the time services are arranged. We reserve the right to reschedule or cancel a session due to weather, facility availability, illness, or other circumstances, and will make reasonable efforts to notify you as soon as possible.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the "Your Brain on Pickleball" name and branding, is owned by or licensed to Joe C. Montgomery and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

7. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party sites, and inclusion of a link does not imply endorsement.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Joe C. Montgomery and Your Brain on Pickleball shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Site or participation in the Services, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Joe C. Montgomery and Your Brain on Pickleball from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your participation in the Services, or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Benton County, Washington.

12. Changes to These Terms

We may revise these Terms at any time by updating this page. Any changes will be effective immediately upon posting, and the "Effective Date" at the top of this page will be updated accordingly. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
